IDCubeCloud: Terms of Service
Effective Date: June 22, 2026
These Terms of Service ("Terms") govern access to and use of IDCubeCloud ("Service"), a cloud-based hyperspectral imaging platform provided by HSpeQ LLC ("HSpeQ," "we," "our," or "us").
By creating an account, accessing, or using IDCubeCloud, you agree to be bound by these Terms.
1. Description of Service
IDCubeCloud provides cloud-based tools for storage, visualization, processing, analysis, sharing, and management of hyperspectral imaging and related scientific datasets.
HSpeQ may modify, update, enhance, or discontinue features of the Service at any time.
2. User Accounts
Users are responsible for maintaining the confidentiality of their account credentials.
You agree to provide accurate registration information and to promptly update such information when necessary.
You are responsible for all activities occurring under your account.
3. Subscription Plans and Billing
Access to certain features of IDCubeCloud may require payment of subscription fees.
Subscription fees are billed according to the selected plan.
Failure to maintain payment may result in suspension or termination of access to the Service.
HSpeQ reserves the right to modify pricing, storage limits, or subscription plans upon reasonable notice.
4. Storage and Cloud Resources
Subscription plans may include storage and computing resources subject to the limits specified for the selected plan.
Users agree not to intentionally misuse, abuse, or excessively consume cloud resources in a manner that negatively impacts other users or the operation of the Service.
HSpeQ reserves the right to impose reasonable limits on resource usage when necessary to maintain platform performance and reliability.
5. Data Ownership
Users retain full ownership of all datasets, images, metadata, reports, and associated intellectual property uploaded to IDCubeCloud.
HSpeQ does not claim ownership of customer data.
Use of customer data is governed by the HSpeQ Privacy Policy and Security & Data Ownership Policy.
6. Confidentiality and Data Access
HSpeQ treats customer datasets as confidential.
Authorized HSpeQ personnel may access customer data only when reasonably necessary to:
Provide technical support
Investigate service issues
Maintain platform functionality
Comply with legal obligations
7. Artificial Intelligence and Machine Learning
Customer datasets uploaded to IDCubeCloud are not used to train artificial intelligence, machine learning, or generative AI systems unless the customer has provided explicit written consent.
8. Acceptable Use
Users agree not to:
Violate applicable laws or regulations
Attempt unauthorized access to systems or accounts
Upload malicious software, malware, viruses, or harmful code
Interfere with the operation of the Service
Use the Service to infringe intellectual property rights
Use the Service for unlawful, fraudulent, or abusive purposes
Users are responsible for ensuring they have the legal right to upload and process any data submitted to the Service.
9. Service Availability
HSpeQ makes reasonable efforts to maintain reliable access to IDCubeCloud but does not guarantee uninterrupted availability.
Scheduled maintenance, upgrades, outages, security events, or circumstances beyond HSpeQ's control may temporarily affect access to the Service.
10. Data Retention and Deletion
Customer datasets remain available while accounts are active and in good standing.
Users may request deletion of their account and associated datasets by contacting HSpeQ support.
Following account termination, HSpeQ may retain data for a limited period to support recovery requests, backups, legal obligations, or system administration before permanent deletion.
11. Disclaimer of Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
HSPEQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF RESULTS.
HSPEQ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HSPEQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF RESEARCH RESULTS.
HSPEQ'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY THE USER TO HSPEQ DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Termination
HSPEQ may suspend or terminate access to the Service for violations of these Terms, non-payment, security concerns, or misuse of the platform.
Users may terminate their accounts at any time.
14. Governing Law
These Terms shall be governed by the laws of the State of Missouri, United States, without regard to conflict-of-law principles.
15. Changes to These Terms
HSpeQ may update these Terms from time to time.
Continued use of the Service following publication of revised Terms constitutes acceptance of the updated Terms.

IDCubeLite End-User License Agreement

This End-User License Agreement (“Agreement”) governs (“user”, “you” or “your”) use of the HSpeQ, LLC applications ( “IDCubeLite” software), provided by HSpeQ, LLC. By installing, using or otherwise accessing the HSpeQ, LLC applications and/or using the information, content, tools, software, features and functionality including any updates and new releases provided through HSpeQ, LLC, you expressly agree to the following terms and conditions contained in this Agreement.
THIS AGREEMENT COMPRISES A LEGAL AGREEMENT BETWEEN YOU AND HSPEQ, LLC (COLLECTIVELY, THE “PARTIES”). PLEASE READ THIS AGREEMENT CAREFULLY. BY INSTALLING OR USING ANY PART OF THE HSPEQ, LLC APPLICATIONS, YOU AGREE TO BE LEGALLY BOUND AND TO ABIDE BY ALL OF THE TERMS AND CONDITIONS HEREIN. IF YOU DO NOT UNDERSTAND OR AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT, PLEASE DO NOT INSTALL OR USE THE HSPEQ, LLC APPLICATIONS.
License:
HSpeQ LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
Restrictions:
You agree not to, and you will not permit others to:
a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.
Modifications to Application:
HSpeQ LLC reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.
Term and Termination:
This Agreement shall remain in effect until terminated by you or HSpeQ LLC.
HSpeQ LLC may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from HSpeQ LLC, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your mobile device or from your desktop.
Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your desktop.
Severability:
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Amendments to this Agreement:
HSpeQ LLC reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
