To better protect your privacy, we provide this notice (the “Policy”) which applies to the information provided or collected through this Site located at www.hspeq.com and www.idcubes.com and in connection with HSpeQ's various services and software products (collectively, "Services").

The Information We Collect

We receive and store any information you enter on our website or give us in any other way (for example, through surveys, questionnaires, the information provided at registration, and in the course of other communications with us). This includes information that can identify you (“personal information”).

When you use IDCubeCloud or other HSpeQ Services, datasets, images, metadata, and associated information uploaded by you may be transferred to and stored on our servers for the purpose of data storage, visualization, processing, analysis, collaboration, and backup services.

When you place an order on our site our merchant services provider requests certain personally identifiable information on the order form. You must provide contact information (such as name, e-mail address, and billing address) and financial information (such as credit card number and expiration date). The merchant services provider processing the order will use this information for billing purposes, for filling your orders, and as described in the merchant services provider's privacy policy. If there is a problem in processing an order, we or they may use the information provided at registration to contact you.

The amount of personally identifying information you provide is up to you, and you are not obligated to provide such information. However, your use of the Site or the Services may be affected if such information is not provided.

You may provide information on behalf of another entity. If you completed the registration or provide information on behalf of a certain entity, you represent to us that you were authorized by that entity to give us consent to use the submitted information.

We also may collect certain non-personally identifying information when you visit our Site or use the Services, such as your IP address, the type of browser you are using, the type of operating system you are using, and access times. We also may collect information about your online activity on our site. We may use third-party contractors to collect and aggregate this information.

The Site and Services are directed to a general audience and we do not offer services directed to children. If we gain actual knowledge that a child under the age of 13 has provided any personal information to us, we will immediately delete this information.

License Key. For IDCubePro and additional packages, we collect and store your computer’s unique identification number. This information will be used for the sole purpose of license key verification and will not be transmitted or sold to a third party.

Surveys or Contests. We may provide you, from time to time, the opportunity to participate in contests or surveys on our site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you, therefore, have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and email address) and demographic information (such as zip code or country).

Customer Testimonials. We may post customer testimonials on the site which may contain personal information. We do obtain the customer's consent via e-mail prior to posting the testimonial to post their name along with their testimonials. To request the removal of your personal information from our testimonials, contact us at support@hspeq.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

How We Use the Information

We may use personal information provided to us as follows:

• We may use account information, usage statistics, system performance metrics, and anonymized operational data to improve our products and services, fulfill requests for products and services, respond to inquiries, process transactions, maintain security, enforce our rights, and resolve disputes.

• Newsletters: If you wish to subscribe to our newsletter(s), we will use your name and e-mail address to send the newsletter to you. Out of respect for your privacy, we always provide you a way to unsubscribe by following the unsubscribe link located at the bottom of each newsletter communication or by emailing us at support@hspeq.com.

• We may use non-personally identifying information that we collect to provide statistical information about users of the Site or Services, to improve the quality, design, and content of our Site, to analyze the use of our Site, and to cooperate with law enforcement.

Information Sharing and Disclosure

We will not sell, share, rent, or trade your personal information with third parties other than as disclosed within this privacy policy. We may disclose your personal information to:

• Third-party vendors who provide services to us or facilitate or evaluate the Sites or Services, such as shipping companies to fulfill orders, credit card processing companies billing for goods and services, live chat providers assisting our clients with the checkout process or if they have questions or concerns regarding our products or services, e-mail service providers sending e-mails on our behalf, and third party vendors who host our shopping cart. Our merchant service provider's privacy policy governs the collection and use of the information collected within the shopping cart area of the HSpeQ Web site; our service provider just hosts the platform and neither we nor our service provider has access to the information collected by the merchant service provider. We may also authorize third-party vendors or service providers to collect information on our behalf.

• Business partners with whom we may jointly offer products or services, or whose products or services may be offered on our website or together with our software. You can tell when a third party is involved in a product or service because their name will appear, either alone or with ours. If you choose to use these products or services, we may share information about you, including your personal information, with those partners. Please note that we do not control the privacy practices of these third-party business partners. If you wish to no longer allow that third party to use your information you may opt out by contacting that third party directly.

• Referring websites. If you were referred to this website from another site (for example, through a link you clicked on another site that directed you to this one), we may share some information about you with that referring website. We encourage you to review the privacy policies of any website that referred you here.

• We may share aggregated or anonymous data with third parties for any use whatsoever.

• In the event that HSpeQ goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred.

Other than as set out above, you will be notified when personal information about you will be shared with third parties, and you will have an opportunity to choose not to have us share such information. HSpeQ does not sell, rent or lease the personal information that you provide about yourself to third parties unless we have your consent.

By providing personal information or using our Site or Services, you consent to the transfer of information outside your country in connection with the transfers of information described in this Privacy Policy, even to countries that might not offer a level of protection for your personal information that is equivalent to the one offered in your country of residence.

We also may share aggregate or anonymous information with third parties without restriction.

Data Ownership

Users retain full ownership of all uploaded datasets, images, metadata, reports, and associated intellectual property.

HSpeQ LLC does not claim ownership of customer data.

Except as necessary to provide technical support, maintain service functionality, comply with legal obligations, or when explicitly authorized by the customer, HSpeQ will not access, publish, distribute, or otherwise use customer datasets.

Authorized HSpeQ personnel may access customer data only when reasonably necessary to provide technical support, investigate service issues, maintain platform functionality, or comply with legal obligations.

Users are responsible for ensuring that they have the necessary rights, permissions, and legal authority to upload and process datasets using the Services.

HSpeQ recognizes that uploaded datasets may contain unpublished research, proprietary information, or confidential business data and will treat such information as confidential except as required to provide the Services or comply with legal obligations.

Artificial Intelligence and Training Data

Customer datasets are not used to train artificial intelligence, machine learning, or generative AI systems unless the customer has provided explicit written consent.

Data Backups

HSpeQ performs routine backups intended to protect customer data against accidental loss. However, users remain responsible for maintaining independent copies of critical datasets.

Cloud Infrastructure

IDCubeCloud is hosted using Amazon Web Services (AWS) and may utilize AWS storage, networking, security, and computing services to provide the platform. Uploaded datasets may be processed on HSpeQ-managed cloud computing resources for visualization, analysis, reporting, and other functions requested by the user.

Data Security

HSpeQ uses commercially reasonable safeguards designed to protect customer information, including encrypted HTTPS/TLS communications, user authentication, access controls, and secure cloud infrastructure.

While HSpeQ employs commercially reasonable safeguards to protect customer information, no method of electronic transmission or storage can be guaranteed to be completely secure

Data Retention

Customer datasets remain available while the account is active and in good standing. Following account termination, HSpeQ may retain data for a limited period to facilitate recovery requests and backup operations, after which the data may be permanently deleted.

Users may request deletion of their account and associated datasets by contacting HSpeQ support.

Cookies and other technologies

Cookies are small data text files and can be stored on your computer’s hard drive (if your Web browser permits). This website uses cookies for the following general purposes:

• To help us recognize your browser as a previous visitor and save and remember any preferences that may have been set while your browser was visiting our site.

• To help measure and research the effectiveness of website features and offerings, advertisements, and email communications (by determining which emails you open and act upon).

By accepting the Terms and Conditions for the Site or the End User License Agreement for our Software (including the terms of this Privacy Policy which are incorporated therein) or using the Site or the Services, you affirmatively consent to receive such commercial messages. As a registered member, you can remove your personal information from our mailing list and to stop receiving future communication from us by following the unsubscribe link located at the bottom of each communication or by emailing us at support@HSpeQ.com. You will also be given the opportunity to unsubscribe from commercial messages in any such email we send. Please note that we reserve the right to send you service-related communications, including service announcements and administrative messages, relating either to your account or to your transactions on this site, without offering you the opportunity to opt-out of receiving them unless you cancel your account.
